Negate Privacy Policy

NEGATE is committed to protecting the privacy of its customers, visitors, and users. Our Privacy Policy outlines how we collect, use, disclose, and safeguard information related to our Service, as well as providing choices regarding the collection and use of information. If you do not agree with our practices, please refrain from using the NEGATE website, Mobile Application Software, or Services.

This Privacy Policy is incorporated into and governed by the NEGATE Terms.

Your use of the NEGATE website, Software, Service, and any personal information you provide on these platforms are subject to the terms of this Privacy Policy and our Terms of Service.

Please note that any content submitted by users of the NEGATE Service, including User Status Submissions, is considered published content and is not considered personally identifiable information covered by this Privacy Policy.

This Privacy Policy does not apply to practices employed by companies not owned or controlled by NEGATE, or individuals not employed or managed by NEGATE, including third parties to whom NEGATE may disclose user information as outlined in this Privacy Policy.

How NEGATE Collects and Uses Information

NEGATE may collect the following types of information from or about you or your mobile phone device, which may include information that can identify you as specified below ("Personally Identifying Information"):

(A) User Provided Information: When using the NEGATE App, you may provide certain Personally Identifiable Information, such as your mobile phone number, push notification name (if applicable), billing information (if applicable), and mobile device information. This information is provided when registering as a user, updating your status, or requesting status for your contacts. To provide the NEGATE App Service, NEGATE may periodically access your address book or contact list on your mobile phone to find the mobile phone numbers of other NEGATE users (referred to as "in-network" numbers) or categorize other mobile phone numbers as "out-network" numbers, which are stored as irreversible hashed values.

(B) Cookies Information: When you visit the NEGATE Site, we may send one or more cookies - small text files containing alphanumeric characters - to your computer to uniquely identify your browser. The NEGATE Site utilizes both session cookies and persistent cookies. Session cookies are temporary and disappear after closing your browser, while persistent cookies remain stored after closing your browser. Persistent cookies can be deleted by following the instructions in your web browser's help file. Your web browser can also be reset to decline all cookies or to notify you when a cookie is being sent. However, disabling essential cookies may result in the NEGATE Site not functioning properly.

(C) Log File Information: Our servers automatically record certain information sent by your web browser when you use the NEGATE Site. This log file information may include your web request, Internet Protocol (IP) address, browser type, browser language, referring or exit pages and URLs, platform type, number of clicks, domain names, landing pages, pages viewed, the order of those pages, time spent on particular pages, date and time of your request, one or more cookies that uniquely identify your browser, your phone number, phone number for status requests, and various status information. Similarly, when using the NEGATE App, our servers log general information whenever a message is sent or received, or if you update or request any status information. This general information includes time and date stamps, as well as the mobile phone numbers associated with the messages.

The data that NEGATE does not collect includes names, emails, addresses, or other contact information from its users' mobile address book or contact lists, except for mobile phone numbers. The association of names with phone numbers in the NEGATE mobile application is done on the user's mobile device itself, and not on NEGATE's servers. This information is not transmitted to NEGATE. In other words, if a user has assigned the name "Alice" to a phone number in their mobile address book, that name will appear in their NEGATE contact list for that phone number. NEGATE does not collect location data, but users can choose to share their location with other users through the NEGATE App.

The messages delivered by the NEGATE App are not copied, stored, or archived by NEGATE as part of its normal business operations. The NEGATE Service functions as an SMS replacement, utilizing data service through a user's phone. Users type their messages, which are sent via data service to NEGATE's servers and then routed to the intended recipient (who must also be a NEGATE user). If the recipient is online, the message is delivered. If the recipient is offline, the undelivered message is stored on NEGATE's server until it can be delivered. If the message remains undelivered for seven days, it is deleted from the servers. Once a message is delivered, it no longer remains on the servers. The contents of delivered messages are not kept or retained by NEGATE. The message content is only stored on the sender's and recipient's mobile devices and may be deleted by the user. However, NEGATE may retain information such as the date and time of successfully delivered messages, the mobile phone numbers involved, and any other legally required information. When files are sent through the NEGATE App, they will reside on the servers for a short period of time after delivery but will be deleted and stripped of any identifiable information in accordance with general retention policies.

NEGATE does not collect age information from users. Once parental consent or authorization is granted, the accounts of minors or individuals under custody are treated similarly to other accounts. Parents or custodians have the ability to change or revoke consent choices and request the deletion of personal data for minors or individuals under their custody for whom they provided consent or authorization.

The Information Usage of NEGATE

If you provide us with Personally Identifiable Information on the NEGATE Site or NEGATE App, we will use it to operate, maintain, and provide you with the features and functionality of the NEGATE Site and App. Your mobile phone number is crucial for using the NEGATE Service and will be retained. Billing information, if provided, will be deleted 30 days after your account with NEGATE is terminated. Any Personally Identifiable Information or status content you voluntarily share on the NEGATE App will be publicly available and may be collected and used by other app users (unless they are blocked by you). Your name (as saved in other users' phone address books) may be displayed to others when you update your status on the NEGATE App, and they may contact you through the app. We will not use your mobile phone number or other Personally Identifiable Information to send commercial or marketing messages without your consent, unless it's part of a specific program or feature where you can opt-in or opt-out. However, we may use your mobile phone number (or email address if provided) without further consent for non-marketing or administrative purposes, such as notifying you about major changes to the NEGATE Site or App or for customer service. We may use both your Personally Identifiable Information and certain non-personally-identifiable information (such as anonymous user usage data, cookies, IP addresses, browser type, clickstream data, etc.) to enhance the quality and design of the NEGATE Site and App, and to create new features, promotions, functionality, and services by storing, tracking, and analyzing user preferences and trends. We may also use cookies and log file information to: (a) remember information so you don't have to enter it again during your visit or the next time you use the NEGATE App or Site; (b) provide custom, personalized content and information; (c) monitor individual and aggregate metrics like the total number of visitors and pages viewed; and (d) track your entries, submissions, views, and similar actions.

NEGATE Discloses Information

Users of the NEGATE App may have access to your User Status Submissions, as long as it aligns with the app's usage. For instance, if you set a status like "Driving in car" using a specific phone number, all users of the NEGATE App who have that phone number in their contact list will be able to see it. This visibility can be blocked if you choose to do so. The "Last Seen" information is also accessible to individuals who have your phone number in their contact list and have not been blocked by you. It shows the approximate time when the NEGATE mobile application was last used or brought to the foreground on your phone. This information is reported to NEGATE when the app is brought to the foreground.

We do not sell or share your Personally Identifiable Information, such as your mobile phone number, with third-party companies for commercial or marketing purposes without your consent. However, there may be specific programs or features where you can choose to opt-in or opt-out. We may share your Personally Identifiable Information with third-party service providers to the extent that it is necessary to perform, improve, or maintain the NEGATE App. Non-personally identifiable information, like anonymous user usage data, may also be shared with interested third parties to help them understand usage patterns on the NEGATE Site, including content, services, advertisements, promotions, and functionality. We may release Personally Identifiable Information and/or non-personally identifiable information if required by law or if we believe it is necessary to comply with laws, respond to legal requests, protect individuals at risk, or protect the rights, property, or safety of NEGATE App, our users, or others.

You have the choice to not disclose Personally Identifiable Information through the NEGATE Site or App. However, this may limit the services that can be provided to you. If you disagree with our Privacy Policy or Terms of Service, you can delete your account, uninstall the NEGATE mobile application, and discontinue using the NEGATE App. Continued usage of the app implies your acceptance of our Privacy Policy and Terms of Service. At NEGATE, we are committed to ensuring the security of your personal information. We employ physical, managerial, and technical safeguards to protect the integrity and confidentiality of your data. However, it is important to note that while we make every effort to maintain the security of our systems, we cannot guarantee that unauthorized third parties will not be able to bypass our security measures or misuse your personal information. By providing your personal information, you acknowledge the inherent risks and understand that you are doing so at your own discretion. In the event of a security breach, we will make reasonable attempts to notify you electronically, either through a notice on the NEGATE website or through the NEGATE App, so that you can take appropriate action to protect yourself.

Age Limitations

To utilize our Services, you must be a minimum of 13 years old. If you are below 13 years old, you must obtain parental consent and agree to parental supervision in order to use our Services.

NEGATE does not gather age details from users. Once parental consent or authorization is obtained, the child's account is treated similarly to any other account. Parents have the ability to modify or retract previously made consent decisions and can also request the removal of personal data belonging to the children for whom they provided consent or authorization.

International Users

The NEGATE Site and Service are based in the United Arab Emirates and are intended for users in the United Arab Emirates. If you are accessing the NEGATE Site and App from the European Union, Asia, North America, or any other region with different laws regarding personal data collection, use, and disclosure, please be aware that by using the NEGATE Site and App, you are agreeing to the U.A.E. law and giving consent to transferring your personal information to the United Arab Emirates.

In the event of a merger, sale, or bankruptcy, NEGATE reserves the right to transfer or assign the collected information from users. In case of our bankruptcy or other similar situations, we may not have control over how your personal information is treated or used.

This Privacy Policy may be updated periodically. Please check back to stay informed about any changes. Your continued use of the NEGATE Site and NEGATE App signifies your agreement to this Privacy Policy and any amendments.
